OBD PORTAL - REFUND AND RETURN POLICY

This Refund and Return Policy applies to all purchases made through shop.obdportal.com operated by OzcarElectronics ("Company", "we", "us").

Please read this policy carefully before making a purchase. By completing a purchase, you agree to the terms outlined below.


1. Digital Products - Tokens

1.1 General Token Policy

Tokens are digital credits used to execute vehicle diagnostic and programming procedures through the OBD Portal software. Due to the digital nature of this product:

  • Tokens are non-refundable once used (consumed by a procedure).
  • Unused tokens remain in your Account and do not expire as long as the Account is active.

1.2 Refund Eligibility for Unused Tokens

You may request a refund for unused tokens under the following conditions:

1.3 Token Consumption and Procedure Failures

To claim a token refund for a software bug or server outage, you must provide:

  • Your Account username
  • Date and time of the failed procedure
  • Vehicle information (make, model, year)
  • Debug logs from the software (if available)
  • Description of the issue

2. Software License

2.1. The OBD Portal software license is a digital product. Once activated and used, it is non-refundable.

2.2. If the software fails to install or activate due to a defect on our end, we will either resolve the issue or provide a full refund within 14 days of purchase.


3. EU Consumer Rights (Right of Withdrawal)

3.1. Under EU consumer protection law (Directive 2011/83/EU), consumers in the European Union have a 14-day right of withdrawal for online purchases.

3.2. Exception for Digital Content: In accordance with Article 16(m) of Directive 2011/83/EU, the right of withdrawal does not apply to digital content (including Tokens) once delivery/consumption has begun, provided you have given prior express consent and acknowledged that you lose your right of withdrawal.

3.3. By purchasing and using Tokens, you expressly consent to immediate delivery and acknowledge that you waive your right of withdrawal once tokens are consumed.

3.4. For unused tokens where delivery has not begun (no tokens consumed), EU consumers may exercise their right of withdrawal within 14 days of purchase for a full refund.


4. How to Request a Refund

To request a refund, contact us through one of the following methods:

  • Subject Line: "Refund Request - [Your Username]"

Please include the following in your request:

  1. Your Account username
  2. Order number or transaction reference
  3. Reason for the refund request
  4. Supporting evidence (screenshots, debug logs, etc.) if applicable

4.1 Processing Time

  • Refund requests are reviewed within 5 business days.
  • Approved refunds are processed within 10 business days after approval.
  • Refunds are issued to the original payment method used for the purchase.
  • Bank processing times may add an additional 5-10 business days depending on your financial institution.

5. Chargebacks

5.1. If you have a concern about a charge, please contact us before filing a chargeback with your bank or payment provider.

5.2. Fraudulent chargebacks (filing a chargeback after receiving and using the Product) will result in immediate Account termination and may result in legal action to recover the disputed amount plus administrative costs.

5.3. Accounts associated with chargeback disputes will be suspended pending resolution.


6. Account Termination and Token Forfeiture

6.1. If your Account is terminated for violation of our Terms of Service (including but not limited to credential sharing, reverse engineering, or unauthorized use), remaining tokens are forfeited without refund.

6.2. If you voluntarily close your Account, unused tokens must be used or a refund requested before Account closure. Tokens remaining at the time of voluntary closure are forfeited.


7. Exceptions and Special Circumstances

7.1. The Company reserves the right to grant refunds outside of the above policy at its sole discretion on a case-by-case basis.

7.2. In the event of extended service outages (more than 72 consecutive hours), affected users will receive token compensation proportional to the disruption.
